Acceptable Use Policy

This policy forms part of our Terms of Service and applies to all use of Podee. It exists because Podee discloses the location of a vehicle and the history of its movements, and information of that nature is capable of being used to cause serious harm.

1. Prohibition on monitoring individuals

In particular, you must not use Podee, or any data obtained through it, to:

• ascertain the present or past location of any individual who has not consented to your knowing it;
• attend at any place because Podee has indicated that an individual would be present there, where that individual has not consented to your knowing their location;
• monitor the movements of a partner or former partner, including for the purpose of verifying an account they have given of their whereabouts;
• monitor any individual in respect of whom you are subject to a restraining order, non-molestation order, stalking protection order or condition of bail;
• harass, intimidate, threaten, coerce or exercise control over any individual;
• establish an individual's routine, or the location of their home or workplace, or of any place they attend, such as a refuge, a place of worship, a clinic or a support group; or
• disclose location data to any other person in order that they may do any of the foregoing.

Vehicles used by other individuals

Where any other person drives or travels in a vehicle you have connected, you must inform them that Podee is collecting the vehicle's location and journey history and that this data is visible to you. That information must be given before they travel, and not afterwards. If any such person is unwilling for you to have access to that data, you must disconnect the vehicle or cease using Podee in respect of it.

Employees and workers

Podee is a consumer product and is not designed for the monitoring of staff. If you nonetheless connect a vehicle driven by a person who works for you, you become a data controller in your own right in respect of that person's personal data, and you must discharge your own obligations under the UK GDPR. Those obligations include informing the individual clearly, identifying a lawful basis, completing a Data Protection Impact Assessment, and refraining from monitoring outside working hours. The Information Commissioner's Office has published guidance on the monitoring of workers which sets out the requirements in full.

Criminal liability

The use of a tracking tool against an individual may constitute a criminal offence in the United Kingdom, including under the Protection from Harassment Act 1997, section 76 of the Serious Crime Act 2015 (controlling or coercive behaviour), the Stalking Protection Act 2019 and the Domestic Abuse Act 2021. Obtaining personal data without the consent of the controller may also constitute an offence under section 170 of the Data Protection Act 2018.

2. Vehicles you may connect

You may connect a vehicle only where you own it, or where the owner or registered keeper has given you permission to connect it. You must disconnect a vehicle without undue delay if you sell it, if you return it at the end of a lease, or if that permission is withdrawn, including where a shared vehicle ceases to be shared upon the ending of a relationship.

3. Prohibited conduct

You must not:

• access, or attempt to access, any account, vehicle or data that is not your own;
• scrape, bulk-export or resell data obtained through Podee, or use such data to compile a competing dataset;
• circumvent rate limits, quotas, metering or access controls, or misrepresent your usage;
• reverse engineer, decompile or copy the service, save to the extent permitted by law;
• introduce malware, or interfere with the operation of Podee or of the infrastructure on which it runs;
• breach Tesla's own terms governing the Fleet API, or do anything through Podee that would place our access to it at risk; or
• use Podee for any unlawful purpose, or to assist any other person in acting unlawfully.

Unauthorised access to a computer system is an offence under the Computer Misuse Act 1990.

4. Security testing

We welcome vulnerability reports, and we will not pursue researchers who act in good faith. Please readour security.txt before commencing any testing, and report your findings tosecurity@podee.app. You must not test against accounts or vehicles that are not your own, must not conduct denial-of-service testing, and must not access, modify or retain the data of any other person.

5. Enforcement

In the case of most breaches we will contact you, explain the matter and afford you an opportunity to remedy it. We may suspend features or limit usage while we investigate.

We will suspend or close an account immediately, and without prior warning, where we believe that Podee is being used to monitor an individual without their consent, or where we consider that the safety of any person is at risk.In such cases we may preserve the relevant records, and we may report the matter to the police or to another competent authority. Where it is safe and lawful to do so, we will notify the individual affected.

We may also act where we are required to do so by law, or where continued provision of the service would place us, our other customers, or our access to the Tesla API at risk.

6. Reporting misuse

If you believe that any person is using Podee against you or against another individual, please write toabuse@podee.app. Tell us what is happening and, so far as you are able, the vehicle or account concerned. You need not hold a Podee account in order to make a report, and we will not disclose to the person reported that you have contacted us. If any person is in immediate danger, call 999 first.
